Delivery Service Terms & Conditions

  1. Scope and acceptance

Further to the Terms of Use (the “Terms”), the below Delivery Service Terms and Conditions regulate the delivery service offered by OLX to facilitate the process of selling and buying, in addition to providing a more convenient and safer environment for our sellers and buyers (the “Delivery Service”), through the website olx.com.eg, related sites and the mobile application of the platform (collectively, the "Website").

These Delivery Service Terms and Conditions are without prejudice to the Terms and any matter not regulated under these Delivery Service Terms and Conditions shall be governed by the Terms. Any term that is not defined hereunder shall have the same meaning granted to it under the Terms. Your usage of the Delivery Service is subject to your acceptance of the Terms and the Delivery Service Terms and Conditions and any other applicable policies or terms of use governing the Website, including OLX’ Privacy Policy https://help.olx.com.eg/hc/en-us/articles/360025115792-Privacy-Policies.

  1. Terms of use

For the purpose of these Delivery Service Terms and Conditions and without prejudice to the Terms, “you or your or user” shall mean any natural or legal person who has agreed to use OLX’ Delivery Service.

  1. The delivery service
  • You understand that the Delivery Service is provided by the entry of OLX into agreements with third party shipping companies chosen at OLX’ sole discretion. Accordingly, you understand and agree that despite the request to use the Delivery Service and other transactions may take place through the Website, the Delivery Service is the responsibility of the shipping company with no responsibility falling on OLX.
  • The Delivery Service provided under these Delivery Service Terms and Conditions is the responsibility of the shipping company with no responsibility falling on OLX.
  • OLX does not bear in any way the responsibility towards the users in connection with the Delivery Service and/or any loss, injury and/or damage that occurs to the items while they are in the custody, possession or control of the shipping company or those resulting from the performance of the shipping company or its failure to perform transportation services. The shipping company shall be held liable with no liability on OLX.
  • You hereby acknowledge and understand that OLX is not responsible for the item being shipped and does not guarantee that the item matches the description mentioned on the Website nor is OLX responsible for the shape or state in which you receive the item or its condition or functionality or anything else that maybe implied by its description on the Website or any other matter agreed upon between you and another OLX user. OLX shall not be held liable if the item you receive, whether upon purchase or return, matches your expectation. OLX shall not be held liable, if in case of a return, you receive an item different than that you sent out or in case you received the item in a condition different than that you sent it out in.
  • You agree and understand that OLX possesses the sole discretion to decide the eligibility of offerings on the Website for the Delivery Service. OLX also possesses the sole discretion to decide on the areas where the Delivery Service is available.
  • You further acknowledge and agree that OLX, including its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, shall not be held liable for any loss or liability, resulting from using the Delivery Service including delays or interruptions of the items pick-up or delivery due to packaging failure, defects, weather changes, or any other cause arising out of the shipping company practices or considered force majeure.
  • You hereby acknowledge and agree that the delivery process and any amounts collected under the Delivery Service shall be based on the information provided by the users under their sole responsibility.
  • You hereby acknowledge and agree that transactions between the users on the Website are consumer to consumer transactions that are not subject to the Egyptian Consumer Protection Law.
  • In the event that the user making the offer (or the seller) is a merchant, the seller acknowledges and undertakes to abide by all applicable laws, including the Egyptian Consumer Protection Law. The seller hereby acknowledges and understands that if their information was requested by the Egyptian Consumer Protection Authority, OLX will comply with the Authority’s request and provide the Authority with the information of the seller available on his profile on OLX, namely, the seller’s name, phone number, address and the transaction history if requested by the Authority.
  • You acknowledge to take all reasonable precautions for safety and soundness of the packaging of the item covered for the delivery of the receiving user. In the event that the items are of a special nature, such as fragile items, you acknowledge and accept to declare to the shipping company the special nature of the item i.e. requiring special handling from the shipping company.

 

  1. Customer support

 

  • Upon submitting the form on the Website, you will receive an SMS from OLX containing the contact information of the shipping company, the package number of the item and a tracking link to track your shipment.
  • The shipping company shall be the first line of support in case the users have any queries in relation to the Shipping Services. If you fail to reach a resolution to your problem / query with the shipping company, you can then refer to OLX as a second line of support.
  • You hereby acknowledge that OLX is not be responsible for any communications between you and the shipping company or any personal data or information you share with the shipping company or any entity or individual claiming to represent the shipping company.

 

  1. Cancellation

 

  • In case of requests for order cancellations, you acknowledge to directly contact OLX for processing any requests pertaining to cancellation of orders.
  • The cancellation request should be raised at least 24 hours before the scheduled pick-up time from the seller. In case the cancellation request is repeatedly made beyond the aforementioned timeframe, OLX may choose to suspend your account from using the Delivery Service. 

 

  1. Payment

 

  • When using the Delivery Service, payment of dues shall be through cash on delivery handled by and under the responsibility of the shipping company. The buyer shall bear the price of the product in addition to the delivery fees (as detailed under https://help.olx.com.eg/hc/en-us/articles/360025122112-What-are-the-fees-for-the-delivery-service-).
  • You hereby agree and acknowledge that any amounts handed to the shipping company shall be under the possession of the shipping company. Any liability related to such amounts during their possession by the shipping company shall fall on the shipping company with no liability or responsibility falling on OLX. You hereby understand that any claim for compensation for any loss of funds or any other issue involving the shipping company shall be made against the shipping company without any involvement or liability on OLX.
  • The shipping company may be entitled to amend the delivery fees in the event that the user entered incorrect data related to the item, particularly the weight of the item.
  • The Website user entitled to the payment will receive their dues in cash, within 7 working days from the date of delivery of the item to the other party.

 

  1. Returns
  • In order to request returning an item, please fill this form (https://olxmena.wufoo.com/forms/z8lezvv06rpd0s/) after you agree with the other party on the time of returning the item.
  • You agree that in the event of returning an item through the Delivery Service, this entails the approval of the involved users (i.e. buyer and seller) on the usage of the Delivery Service to return the item.
  • You hereby acknowledge, understand and agree that despite requesting the Delivery Service to return an item through the Website, OLX is not in any way responsible of the return process, the condition of the item returned or any amounts due to any of the users.
  • Payment of the dues in case of returns shall be in line with section “4. Payments” under these Delivery Service Terms and Conditions. The users shall agree on the party bearing the shipping fees for returning the item.   • As previously mentioned, you hereby acknowledge and agree that the delivery process and any amounts collected under the Delivery Service shall be based on the information provided by the users under their sole responsibility.

 

  1. Indemnification

 

Without prejudice to the Terms, you agree to defend, indemnify and hold harmless OLX, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys' fees) arising directly or indirectly from the use of the Delivery Service.

 

  1. Personal data protection
  • Without prejudice to OLX’ Privacy Policy (https://help.olx.com.eg/hc/en-us/articles/360025115792-Privacy-Policies), you explicitly agree and authorize OLX to collect, transfer, store and process any personal information provided by you while filling the delivery request for or anywhere else on the Website or otherwise collected by OLX. This is to enable OLX to provide you with a better service and create a safer environment for its users. We will retain your information for as long as we can for the same purposes.
  • You authorize and hereby unconditionally agree to receive communications from OLX in any form (including push notifications, calls, SMS, emails, etc.) for the purpose of confirming Your request to use the Delivery Service and updating you on the status of the delivery. You also acknowledge and agree that OLX shall retain your information for future use.
  • You agree to provide true, current and complete information, and in the event that OLX has reasonable grounds to suspect that any user’s information is untrue, inaccurate, not complete, or there was any abuse of service by any means from the users; then OLX shall have the right to suspend or terminate the user’s account and prohibit any and all current or future use of OLX’ Website.

 

  1. Eligibility

 

  • You acknowledge and hereby accept that OLX shall have the sole discretion whether to accept or reject the eligibility of items on the Website to the Delivery Service.
  • You further accept and agree that OLX has the sole discretion to exclude items that are prone to become rapidly damaged or that require certain requirements or licenses in order to be circulated.
  • You understand that currently the Delivery Service is available for all items displayed on OLX except for cars, vehicles, large home appliances and furniture, pets, jewelry, tickets, food or edible items in addition to any item that is restricted, forbidden or considered illegal under Egyptian law. This is subject to change according to OLX’ sole discretion.
  • All items registered in OLX’ Website are eligible only upon satisfaction of all of the conditions mentioned below:
  1. The weight of the item is of a maximum of 30 kilogram;
  2. The price of the item does not exceed EGP 10,000.
